1. Terms and conditions of use
1.1. Use of this website grants anyone who accesses it, whether a natural or legal person, the status of User (hereinafter, the “User”), which implies full acceptance of the general terms and conditions of this Legal Notice, in the version published at each moment of access to that website and/or domain.
1.2. The User is advised to read this Legal Notice carefully before using the services and content offered. Access to and/or use of certain services may be subject to particular conditions which, depending on the case, replace, supplement or amend these conditions.
1.3. If the User does not accept the terms of use, the User must refrain from accessing or using the services and content of this website.
1.4. The website owner reserves the right to modify, update or remove, at any time and without prior notice, the content, services or information on the website, as well as to limit or cancel the applicable terms and conditions.

1.12. Any personal data the User may provide will be processed in accordance with the Privacy Policy, available in the Legal Notice of our website, and in accordance with the personal data protection legislation in force.
1.13. The User undertakes to use the website, its content and services in accordance with applicable law, good faith, generally accepted standards of behaviour and public order.
1.14. In particular, the User undertakes not to carry out the following actions:
1.14.1. Use the website for unlawful purposes or purposes contrary to these conditions, that harm the rights or interests of third parties, or that may damage, disable or impair the site or its services.
1.14.2. Destroy, alter or damage the data, programs or electronic documents of the website or of third parties.
1.14.3. Introduce programs, viruses, macros or any other logical device or character sequence that may cause alterations to the computer systems of the owner or of third parties.
1.14.4. Make unauthorised use of information, images, recordings, texts, graphics or other content accessible through the website.
1.14.5. Disseminate discriminatory, defamatory or violent content or comments, or content contrary to fundamental rights.

1.17. The owner may temporarily suspend the website's services in order to carry out maintenance, improvement or repair work, without this giving rise to any right to compensation for the User.
2. Privacy policy
2.1. Our privacy policy applies to Free Human's processing of the personal data of our Users, suppliers, partners and/or related third parties.
2.2. At Free Human we consider “personal data” to be any type of information that, on its own or in combination with other information, identifies or makes it possible to identify individuals. Information such as, for example, first name, surname, postal address, email address or telephone number, among others.
2.3. Based on the principle of minimisation, the data we collect at Free Human for subsequent processing will always meet the criteria of adequacy, relevance and limitation, so that its use is strictly necessary in light of the purposes for which it was collected and processed, always respecting the User's wishes.
2.4. The data that may be processed by Free Human is classified into the following categories:
2.4.1. User data: the set of information formed by contact details (such as first name and surname), age, payment behaviour, as well as any type of information collected, where applicable, through Free Human's enquiry and customer service channels (for example, complaints or related enquiries), including information obtained through visits to Free Human's websites, as well as the User's interactions with Free Human, whether by telephone (in which case calls may be recorded), through its social networks (through User comments on Free Human's official profiles and/or through the User's participation in prize draws, promotions and other promotional activities carried out by Free Human) or other official applications or media.
2.4.2. Data on Free Human products or services: the type of Free Human products or services contracted by the User through its website, by telephone or through any other official channel (physical or virtual) made available for that purpose.
2.4.3. Web visit data: the public IP address of each connection made by the User, including the date and time of connection, the DNS query, the web pages consulted or the applications used by the User to gain access, the User's behaviour on the website (for the purpose of correcting errors in online development and enabling more appropriate and comfortable browsing for the User), the time spent browsing, as well as data relating to the devices and browsers used by the User.
2.5. That said, Free Human hereby informs you that contracting its products and services may involve the processing of other categories of data not included in this list. In such a case, the User will be informed in the specific privacy conditions for each of the products or services concerned, and their consent will be obtained where necessary, in accordance with applicable legislation.
2.6. In addition, Free Human informs you that when purchasing or enquiring about any of its services or products, the User will have the option of subscribing to periodic communications and/or newsletters (sent electronically and/or in writing, among other means) regarding Free Human's services and/or products and those of other third parties with which it collaborates. Subscription is voluntary and the User may unsubscribe at any time without having to justify their decision. Through this voluntary subscription, Free Human may collect and process the User data described above for the commercial promotion of its own products and services and/or those of third parties collaborating with Free Human.
2.7. Free Human also informs you that the data processed may be anonymised in compliance with all the safeguards established by applicable legislation, as well as by other permitted measures. In this regard, please note that the principles of personal data protection do not apply to information provided anonymously (such as, for example, information provided in satisfaction surveys, comments, etc.).
2.8. 2.9. In order to comply with applicable legislation, it may be necessary to disclose our Users' personal data to public institutions or other supervisory authorities as a result of Free Human's legal obligations. Third parties may also have access to the User's personal data on the terms set out in this Legal Notice.
2.10. Free Human will process the User's personal data for its internal management, centralising data processing for efficient management. Where applicable, policies for the control, management and use of the data included will be implemented for the development of internal processes in relation to customers, suppliers and business partners, as well as for the performance of other specific tasks.
2.11. Free Human is especially committed to the privacy of Users in general, and of its customers in particular. For this reason, any data collected by Free Human through its website will only be used for the purpose requested by the User and provided for in this privacy policy. Accordingly, unless express consent is given, the User will not receive commercial communications from Free Human or from third parties, and their data will not be transferred to third-party companies at any time.
2.12. At Free Human we collect and process User data so that the provision of our services and the sale of our products are as transparent, efficient, complete and confidential as possible, but above all so that the User experience remains completely satisfactory. Therefore, and in order to achieve other purposes permitted and authorised on the terms set out in this privacy policy, the reasons why Free Human collects and processes User data include, among others, the following:
2.12.1. To establish a direct communication channel with the User in order to provide information on various matters (including, for example, new products, special offers or, where applicable, the notification of incidents and/or related matters).
2.12.2. Where the User subscribes to our communications and/or newsletters, to keep the User informed at all times about our products and services, as well as about prize draws.
2.12.3. Using the information collected from the User's personal data, Free Human can design future campaigns and projects in order to faithfully meet each User's specific needs.
2.12.4. To improve the quality of technical and commercial support, and to verify User satisfaction, through electronic channels or through the recording of the User's calls to the customer service numbers made available for that purpose, or of calls that may be made to the User by Free Human or by any company authorised by it.
2.12.5. To produce statistics, surveys or market research aimed at assessing the quality of the product or service provided by Free Human, as well as decision-making in relation to the User experience.
2.12.6. To maintain the security of electronic communications networks and services, detect technical faults or errors in the transmission of electronic communications, as well as any processing necessary for Free Human to provide its service correctly through its various channels (physical or electronic).
2.12.7. To detect or prevent abusive or fraudulent use of the services.
2.12.8. Any other purpose that is mandatory and necessary in accordance with applicable legal provisions.
2.13. In addition, during the term of the relationship established between Free Human and the User, other data may be incorporated for these or other purposes, in which case the User will be duly informed at the time the data is collected (for example, through the various commercial service channels, whether in person, through the online channel or even in forms completed on the website).
2.14. Free Human accepts no responsibility for the use of false, inaccurate, incomplete or out-of-date data provided by the User.
2.15. The User guarantees, both to Free Human and to third parties, the quality of the information provided. That is, that the data and information provided are real, accurate and up to date and belong to the User and not to third parties. Therefore, by sending their personal data to Free Human, the User guarantees and accepts responsibility, both towards Free Human and towards third parties collaborating with Free Human, that such data is true and complies with that principle of quality and accuracy. In all cases, the supply of false or out-of-date data is prohibited.
2.16. Where applicable, the User must always identify themselves with their personal email address and with true and current data.
2.17. Free Human informs the User that, in compliance with the principle of storage limitation, the data collected will be processed solely and exclusively for as long as necessary and for the purposes for which it was collected at each moment. It will therefore be kept in a form that permits the identification of data subjects for as long as necessary for the purposes of the processing of personal data.
2.18. That said, Free Human has established the following retention periods, which depend on the type of User data and apply unless a different period has been specified in this privacy policy or in the conditions of provision of each of the products and services Free Human may offer:
2.18.1. Customer data: data will be retained for the duration of the contractual relationship plus an additional maximum period of four (4) years after the end of the contract, pursuant to the Spanish Civil Code and the corresponding tax legislation.
2.18.2. User data: data will be retained for a period of twelve (12) months, unless it is information necessary for the provision of services requested by the User themselves, such as subscriptions to periodic communications or newsletters (in which case it will be retained indefinitely until the User requests to unsubscribe voluntarily from the service).
2.18.3. Data on possible products or services provided by Free Human and its collaborators: data will be retained for the duration of the relationship established between Free Human and the User plus an additional maximum period of four (4) years after the end of that relationship, pursuant to the Spanish Civil Code and the corresponding tax legislation.
2.18.4. Traffic, web visit and location data: data will be retained for a period of twelve (12) months.
2.19. We inform you that the data you provide to Free Human will generally not be transferred to other persons or companies to be used for their own purposes.
2.20. Notwithstanding the above, as a result of the products and services provided by Free Human and the agreements it may have with collaborating business partners, third parties linked to Free Human's activities may have access to the User's personal data (for example, among others, business partners that make products in collaboration with Free Human, insurance companies, IT technical suppliers, marketing and digital agencies, authorised representatives, anti-fraud agencies and offices, regulatory authorities, government agencies and supervisory authorities, among others).
2.21. Access by third parties to the User's personal data by virtue of their link with Free Human is governed by agreements entered into for the purpose of regulating the conditions under which access to and processing of the User's personal data will take place, in such a way as to guarantee that the User's personal data is processed solely and exclusively for the purpose indicated by Free Human. Accordingly, those third parties may act as data processors and will be contractually obliged to comply with their legal obligations as data processors and to maintain the confidentiality and secrecy of the information.
2.22. Should those third parties have access to the User's personal data, Free Human will implement the technical, organisational and contractual measures necessary to ensure that their personal data is processed only to the extent required by the processing carried out by those third parties or by the consent given.
2.23. If Free Human requires further processing of the User's personal data for a purpose other than those set out in this privacy policy, prior information will be provided, including all legally required information as well as the purposes envisaged for such processing.
2.24. Free Human is committed to guaranteeing the security and confidentiality of any User's personal data and information. To that end, where necessary, Free Human will implement security measures and technical means to prevent its loss, misuse or unauthorised access.
2.25. Free Human may update this privacy policy at any time for business reasons, notifying the User in the event that such an update entails a substantial change to it. Users are therefore advised to review this policy periodically.
2.26. Use of any of our services, through any of our channels (whether electronic or in writing), once this change has been notified or has taken place, implies the User's knowledge of it on the terms set out in the newly published privacy policy.
2.27. Free Human's privacy policy is made up of this document, together with the specific privacy conditions of each of the products and/or services Free Human may offer, which will be supplemented and interpreted coherently and systematically, respecting in all cases the User's wishes regarding the general processing activities included here, without thereby affecting the specific conditions of any services contracted.

2.29. Likewise, in accordance with applicable legislation, Free Human informs you that, through the aforementioned email address contacto@freehuman.global, or by post sent to Free Human's registered office, the User, attaching a copy of their National Identity Document (DNI) or passport, may exercise the following rights:
2.29.1. Access: allows the data subject to obtain information as to whether or not Free Human processes personal data concerning them and, if so, the right to obtain information about their personal data undergoing processing.
2.29.2. Rectification: allows errors to be corrected and data that turns out to be inaccurate or incomplete to be amended.
2.29.3. Erasure: allows data to be deleted and to stop being processed by Free Human, unless there is a legal obligation to retain it and/or other legitimate grounds for its processing by Free Human prevail. For example, where personal data is no longer necessary in relation to the purposes for which it was collected, the User may request its erasure without undue delay.
2.29.4. Restriction: under the conditions established by law, allows data processing to be halted, so that future processing by Free Human is prevented and it retains the data only for the exercise or defence of claims.
2.29.5. Objection: in certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data. Free Human will stop processing the data, except on compelling legitimate grounds or for the exercise or defence of possible claims.
2.29.6. Portability: allows the data subject to receive their personal data and to transmit it directly to another controller in a structured, commonly used and machine-readable format. To exercise this right, the User must provide a valid email address.
3. Minimum age
3.1. In accordance with the legislation in force in Spain, in order to use this website the User must be over eighteen (18) years of age or, where applicable, have the authorisation of their parents and/or legal guardians if they are over fourteen (14) and under eighteen (18) years of age. Therefore, by accepting this privacy policy, the User guarantees that they are over that age or that they have the aforementioned parental authorisation to register on any of the channels used by Free Human, assuming full responsibility for that declaration.
4. Cookie policies
4.1. What are cookies?: Cookies are small text files that are installed in the browser of the customer's and/or User's computer to record their activity, sending an anonymous identifier that is stored there. They can also be used to measure audience, traffic and browsing parameters and session time, and/or to track progress and the number of entries. The cookies on this website may be either session or persistent cookies, as well as first-party or third-party cookies. Session cookies are those that are automatically deleted when the browser is closed, whereas persistent cookies may remain installed for a specific period. First-party cookies are those installed by Free Human, whereas third-party cookies are those installed by service providers engaged for that purpose.
4.2. Free Human will at all times endeavour to establish appropriate mechanisms to obtain the customer's and/or User's consent for the installation of cookies that require it. However, in accordance with Spanish legislation, it will be understood that (i) the User has given their consent if they change their browser settings to disable the restrictions that prevent cookies from being installed, and (ii) that such consent is not required for the installation of cookies that are strictly necessary for the provision of a service expressly requested by the User. Please note that in order to use the website the User must have cookies enabled, especially technical cookies, which are necessary for Free Human to identify the User each time they access the website.

5. Miscellaneous
5.1. Should any of the provisions of this legal notice, or part of them, be declared unlawful, invalid or unenforceable by a competent administrative or judicial body, it will be deemed not to have been included, without this affecting the remaining provisions.
5.2. Any delay or failure by Free Human to bring legal action or exercise any right described in this document does not in any case imply a waiver of those rights.
5.3. Likewise, the failure to claim a breach of the obligations set out in this document does not entail a waiver of a subsequent claim.
5.4. In accordance with Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), the policy for sending electronic communications is limited exclusively to those messages that the User has expressly and voluntarily requested.
6. Applicable law and jurisdiction
6.1. The relationship between Free Human and the User will be governed by the Spanish legislation in force, and any dispute will be submitted to the Courts and Tribunals of the User's domicile.
